These Terms and Conditions
govern your use of the Albany Hill web site, www.albanyhill.com website
and your relationship with Albany
Hill (“Albany Hill”, “us”or “we”).
Please read them carefully as they affect your rights and liabilities
under the law. If you do not agree to these Terms and Conditions,

site you agree to be bound by these Terms and Conditions.

these Terms and Conditions from time to time and any changes will be notified
to you via the email address provided by you on registration
or via a suitable announcement on the albanyhill.com site. If you continue

into effect, your use of the Albany Hill site indicates your
agreement to be
bound by the new Terms and conditions. Nothing in these terms and conditions
affects your statutory rights.

Proprietary Rights
The content
of the Albany Hill site is protected by copyright
and intellectual property rights. You may retrieve and display the content
of
the Albany Hill site on a computer screen, store such content
in electrical form on disk (but not any server or other storage device
connected

a network), or print one copy of such content for your personal, non commercial

Prices and VAT
All
our prices are stated in pounds sterling (£). Payment in any currency other than sterling will be governed by the exchange
rate currently in use on the day when the customer’s credit card
is charged with the sterling payment amount.
Albany Hill is not VAT registered and we do not charge value added tax to
any of our customers.
Customers purchasing goods for delivery to addresses outside the United
Kingdom may incur additional import duties and custom charges levied by local
customs.
These are levied at the port of ingress on a consignment-by-consignment
basis and Albany Hill cannot predict if they will be charged or influence
if and how they must be levied. Payment of such charges will be the sole
responsibility of the Customer, and under no circumstances will Albany Hill
be liable for their payment.
Acceptance of your order
“Purchaser” means
the person whose order has been accepted by Albany Hill.
The “Recipient” means
the person who receives goods from Albany Hill and purchased by the Purchaser.
Our products are sold for personal use only. Products cannot be re-sold
unless express written consent is obtained from Albany Hill.
As soon as an order is placed, the Purchaser is deemed to have agreed to,
and is bound by, the terms and conditions herein described by Albany Hill.
A contract of sale is deemed to exist as soon as Albany Hill despatches
an email message to the purchaser, confirming that Albany Hill has received
the purchasers order, regardless of whether the purchaser receives the confirmation
email or not.
Albany Hill
will use its reasonable endeavours to deliver goods promptly but accept
no liability for delay in delivery for any cause.
It
is the Purchaser’s responsibility to ensure that goods purchased
at www.albanyhill.com for delivery to addresses outside the United Kingdom
do not contradict any current legislation governing their own country’s
import regulations and restrictions. Should the purchaser be in any doubt
as to the suitability of any such goods they should contact their local
customs office for advice.
Product Availability
We
feature products on our website that have been carefully selected for
online shopping. Should
any item
on the albanyhill.com site become unavailable
for sale we will change the status of such said items to “out of
stock” on
the www.albanyhill.com site at the earliest opportunity. If items you
order are out of stock, or subject to a delay, we will try to contact
you at
the email
address you provided when placing your order. If we cannot contact you
or receive no response to our email, we will continue to process the
remaining items on your order. All items are subject to availability.
If, due to unforeseen circumstances, it is necessary to substitute an item,
the item will be of equal or greater value than that which it replaces. Substitutions
are only made with the customer prior consent.
Deliveries
Please allow 10 working days for delivery to addresses within the United
Kingdom. Please allow an additional 10 working days to addresses outside the United
Kingdom. Please note that working days exclude bank holidays.
Delivery
charges are calculated by weight and destination and are clearly displayed
at “checkout” for
your approval prior to confirming your order.
When ordering chocolates and other confectionery we advise against deliveries
to warmer countries and/or in summer months when temperatures are higher
than that of the United Kingdom. We have no control over the temperatures
during international deliveries and so we cannot accept responsibility for
any deliveries that have been heat damaged.
We do our best to deliver within 28 days of the date of your order but shall
not be liable for loss occasioned by delay in delivery arising out of any
cause beyond our control.
Returns / Cancellations
If you are
not entirely happy with any of the products you receive you must advise
us within 28 days of receipt of the goods so that we can arrange for
a refund. Damaged goods must be reported to us within seven days of receipt.
This returns policy does not apply to products which have been opened or used. Customer’s
statutory rights are unaffected.
Please do not return any items without first contacting Albany Hill.
A Returns
Form and returns label will be included with your order, with clear instructions
on how to return merchandise to us. Complete the returns
form, package the merchandise to prevent damage, enclosing the returns
form attach the returns label and send the merchandise using registered
post or
another secure method of delivery, retaining the receipt until you have
received credit for your return.
Please
note that return costs are not pre-paid. Postage or other return costs
will be the customers responsibility and will be reimbursed by us only
in the case of damaged, faulty or incorrectly supplied goods, together
with their packaging, in the same condition as supplied to you.
If you wish to cancel an order you can do so by contacting us. We regret
that we can only do this if your order has not been despatched, either in
part or in full.
Once
despatched, any such goods must be returned as detailed in the returns
policy above.
